GENERAL TERMS AND CONDITIONS

 

ARTICLE 1: DEFINITIONS

If you are or wish to become a member and use our services or products, we are happy to do so with clear and transparent agreements. A kind of set of rules, in other words. By registering, you declare that you accept these general terms and conditions and the house rules of Gorilla Gym and Khaled Zarin Fighting Center and that you will act in accordance with them. The general terms and conditions and house rules can be found at www.gorillagym-vlissingen.nl and can be requested at the reception desk at Gorilla Gym/Khaled Zarin Fighting Center in Vlissingen. 

Gorilla Gym: This refers to the services and products we offer under the name Gorilla Gym in Vlissingen (Gorilla Gym B.V.). Khaled Zarin Fighting Center may also be referred to as Gorilla Gym in the general terms and conditions; the terms and conditions apply to both.

Gorilla Gym pass: This is your access pass to enter Gorilla Gym.

Extra: these are the services or facilities that can be purchased from Gorilla Gym for a fee in addition to the basic membership.

 

Host/hostess: Our Gorilla Gym employee who is responsible for managing Gorilla Gym.

Commencement date: The agreement commences on the day of your registration. The commencement date will be postponed if you take advantage of a promotion, such as free workouts until July 1. For example, if you register on May 12, the commencement date of your agreement will be July 1. You can, of course, already work out between May 12 and July 1, and in the case of this promotion, you will not owe any payment, subject to Article 6. This does not affect the fact that these terms and conditions will apply from the moment of registration. 

Registration: A registration that makes you a member of Gorilla Gym. This can be done in one of the ways described in Article 2a. The memberships that are taken out are combined for Gorilla Gym and Khaled Zarin Fighting Center, and the general terms and conditions apply to both.

Youth member: You can become a member with us from the age of 5. Between the ages of 5 and 16, you are a youth member. To become a youth member, you must register at Gorilla Gym with one of your parents or legal guardians, who must give their consent to your agreement by signing it. If you are between 5 and 16 years old, you are only welcome to participate in the Kids kickboxing classes. In exceptional cases, you may use other facilities at Gorilla Gym, under the supervision and responsibility of your parents/guardian.

 

Member/Members: You can become a member if you are a natural person. Gorilla Gym may ask you to prove this by providing identification that you are the person to whom the Gorilla Gym membership card belongs. 

Membership agreement or agreement: The agreement that is created between Gorilla Gym and the member upon registration. These general terms and conditions are also part of your agreement, as are any specific terms and conditions that may apply to extras.

Khaled Zarin Fighting Center: This is the kickboxing school that is also located in Gorilla Gym.

ARTICLE 2: MEMBERSHIP AND ACCESS

a. You are welcome to become a member of Gorilla Gym. You can do so in the following ways:

1. At Gorilla Gym by filling out the registration form at the front desk. 

b. If you register at Gorilla Gym, you have the right to cancel your membership within 14 days of the day of registration without giving any reason. You can do this in one of the ways described in Article 11 b of these general terms and conditions. If the 14th day falls on a weekend or a nationally recognized holiday, the cooling-off period will run until the end of the first following working day. If you decide to cancel your membership within the 14-day cooling-off period and the membership has not been used during that period, this cancellation is free of charge. If the membership has been used during this period, Gorilla Gym may charge a pro-rata fee for the membership (from the activation of the membership until the day of withdrawal, including any registration fee).

c. If you become a member of Gorilla Gym, you owe membership fees from the moment of registration. The SEPA direct debit authorization will also apply from that moment. If you do not meet your payment obligations, Gorilla Gym may decide to terminate the agreement. To enter Gorilla Gym, you need your own Gorilla Gym card.

ARTICLE 3: GORILLA GYM PASS

a. The Gorilla gym pass is the property of Gorilla gym and may be used during the term of the agreement.

b. You may not transfer your membership to anyone else. No one else may use your personal pass to exercise at the gym.

c. As a Member, you are responsible and liable for the use or misuse of the Gorilla Gym Pass and membership. 

d. If you lose your Gorilla Gym Pass or if it is stolen, you can purchase a new pass at the Gorilla desk. This will automatically block the stolen pass. The replacement fee for a new pass is €5.00. This fee must be paid at the Gorilla desk, after which the pass will be activated. In the meantime, your payment obligation remains in force.

ARTICLE 4: MEMBERSHIP, TERM

a. We offer various types of membership, all details of which can be found on our website and at Gorilla Gym. 

b. When registering, you can indicate which type of membership you wish to sign up for. All our membership types are for a minimum of 12 months with automatic (monthly) renewal for an indefinite period.

ARTICLE 5: EXTRAS

a. Gorilla Gym provides free water in the gym. This is available to all members and their friends. It is mandatory to use a drinking cup or water bottle. Drinking directly from the tap is not allowed for hygiene reasons for the other members.

b. At the front desk, you can purchase additional kickboxing classes if these are not already included in your membership.

c. At Gorilla Gym, we offer new members the opportunity to take up to three personal training sessions. Please inform the staff if you would like to take advantage of this, and appointments can be scheduled. During the personal training sessions, you will receive an explanation of the equipment and how to use it. If you still have questions after the training sessions, you can always ask the Gorilla Gym staff without obligation.

ARTICLE 6: RATES AND PAYMENT

a. All membership types have their own membership rates and conditions, which can be found on the website or at Gorilla Gym.

b. When you become a member of Gorilla Gym, we charge a registration fee. This registration fee may vary per membership type if there is a promotion. If you have terminated your membership and wish to rejoin, you will be required to pay the registration fee again.

c. All membership fees are payable in advance and are due and payable. 

d. If you opt for a one-year contract, with full payment in advance, the first annual payment will be made upon registration by online payment or card payment at the desk. If you wish to renew your subscription after this year, you must fill in a form at the desk to renew and pay (this can be done by debit card, bank transfer, or direct debit).

e. If you opt for monthly payments with a one-year contract, the first payment will be made upon registration via SEPA direct debit at the set monthly rates calculated pro rata, and subsequent payments will be made in advance each month via SEPA direct debit at the set monthly rates.

i. We may increase our rates once a year. If we do so, this does not entitle you to terminate the agreement, unless the rate increase takes place within three months of the conclusion of the agreement. Rate adjustments due to government measures may be implemented immediately, regardless of the amount, and do not entitle you to terminate the agreement.

j. If you do not make use of the agreement or the extras, the membership fee will not be refunded.

ARTICLE 7: OPENING HOURS

a. Gorilla Gym will indicate its opening hours. Circumstances may require different opening hours to apply, for example in the event of emergencies or public holidays. Gorilla Gym may remain closed in such cases. This may also be the case if, for example, we need to carry out necessary work at Gorilla Gym.

b. We want to maintain Gorilla Gym properly, and sometimes we cannot avoid temporary or partial closure. In that case, you are not entitled to a refund of your membership fee.

ARTICLE 8: GROUP LESSONS

a. We want to keep our range of lessons up to date at all times. This means that we regularly adjust the (content of the) lessons, the type of lessons, and the lesson schedule.  During holidays, there is generally also an adjusted class schedule with fewer/no classes.  The adjustments do not entitle members to a (partial) refund of their membership fee.

b. Gorilla Gym reserves the right to refuse access to classes to certain individuals.

c. Athletes and visitors must comply with the general terms and conditions and house rules during their stay in the Gorilla Gym premises. They must also follow the instructions given by Gorilla Gym employees. Failure to comply with these rules may result in removal from the premises.

d. Any act, omission, or behavior by an athlete or visitor to Gorilla Gym that violates one or more provisions of these general terms and conditions or the house rules and that may harm the name and/or business of Gorilla Gym and/or its athletes Gorilla Gym reserves the right to terminate the membership agreement with immediate effect and to deny the person(s) concerned access to the Gorilla Gym premises, without this giving rise to a refund of the tuition fees.

e. Gorilla Gym may cancel classes or training sessions if there are valid and urgent reasons for doing so, including situations of force majeure. Examples include an insufficient number of participants (minimum of 6 people), unexpected and/or prolonged illness of trainers, etc. Cancellations do not entitle participants to a (partial) refund of their membership fees.

f. A mouth guard/mouthpiece is mandatory for everyone who takes kickboxing classes. Without a mouth guard/mouthpiece, the trainer may deny the athlete the right to participate in the class.

g. Only participate in classes/training sessions that match your fitness level. If the trainer believes that you have registered for a class/training session that does not match your fitness level, the trainer will decide whether you can participate in the class/training session or not.

h. It is not permitted to leave the training area during classes without the instructor's permission.

i. Drink enough fluids, as dehydration can cause loss of concentration.

j. Jewelry must be removed during classes. Make sure you do not have any sharp objects in your pockets during classes.

k. Chewing gum and other food are prohibited during classes.

l. Long hair must be tied back during classes.

 

ARTICLE 9: GENERAL RULES

a. General

1. Treat each other with respect at all times.

2. Discrimination or other forms of undesirable behavior will not be tolerated at our gym.

2. Only water bottles/cycling bottles with a sealable cap are permitted.

3. Smoking, alcohol, drugs, and performance-enhancing substances are strictly prohibited at Gorilla Gym.

4. Eating food is not permitted in any of the gym areas. You may eat at the dining table or reception desk.

5. In order not to disturb other members, we ask you to silence or switch off your cell phone. Loud (telephone) conversations are not permitted.

6. During training, you must wear clean and appropriate sportswear. If you are taking multiple classes and/or training sessions (one after the other), please bring extra clean sportswear and an extra towel.

7. Pets are not allowed.

8. Coaching and supervising other athletes is prohibited. If you do so anyway, your membership will be terminated immediately.

b. Fitness room

1. Use a towel on the equipment.

2. Return equipment and weights to their proper place. Do not leave weights hanging on the equipment.

3. It is forbidden to walk in the room with outdoor shoes.

4. After using cardio and/or fitness equipment, clean it immediately with disinfectant (do not wet the screen).

5. Eating and drinking from cans is prohibited in the gym.

6. Shirts must be worn (no bare chests).

7. Water bottles and other bottles must be kept tightly closed.

8. Closed-toe shoes must be worn in the fitness room.

9. Bags must be stored in lockers or the changing room. It is forbidden to take your bag with you during training and to place it on the floor in the gym.

c. Martial arts hall

1. It is forbidden to enter the hall with shoes on. 

2. Return equipment to its proper place.

3. Put bags in the lockers. Do not leave bags on the floor, as people may trip over them.

4. Eating and drinking from cans is prohibited in the hall.

5. Keep shirts on (no bare chests).

6. Keep water bottles and other bottles tightly closed.

d. Changing rooms

1. After showering, dry yourself in the wet area of the changing room to prevent falls and unnecessary soiling of the changing rooms. 

2. Changing clothes should only take place in the changing rooms.

3. For hygiene reasons, shaving in the changing rooms is not permitted.

e. Children

1. The age limit for group lessons is 5 years or older. The registration form must be signed by a parent or guardian. 

2. Children under the age of 16 may only use the Gorilla Gym fitness area under the supervision of a parent or guardian.

3. Any injury to children or damage to children's property caused by access to the Gorilla Gym premises, whether authorized or unauthorized, is at the risk of the parent/guardian.

 

f. House rules and rules of conduct for the member's parents/guardians:

1. The parent/guardian is a good supporter and sets a good example by showing respect for everyone.

2. The parent/guardian shall remain uninvolved in the supervision and training of members by trainers and supervisors.

3. The parent/guardian shall ensure that their son/daughter arrives on time for training or a competition.

4. The parent/guardian shall wait at the reception desk or elsewhere during their son/daughter's lesson.

5. The parent/guardian ensures that their son/daughter cancels their participation in a training session or competition in good time.

6. The parent/guardian addresses any misconduct on the part of their son/daughter.

ARTICLE 10: MEDICAL INFORMATION/SUSPENSION OF MEMBERSHIP

a. We hope that you are in good health when you come to exercise with us. If, for medical reasons, you are permanently unable to use your membership, you can, in consultation with Gorilla Gym staff, suspend your subscription for a maximum of 6 months or terminate it prematurely, subject to a notice period of 30 days from the date of notification. You must then notify us (by email) that you are no longer able to use your agreement due to your medical situation.

b. We request that you share relevant medical information/medical restrictions or chronic illnesses with Gorilla Gym staff (e.g., asthma) so that we can respond appropriately if necessary.

c. If pregnancy can be demonstrated, suspension of the membership for up to 6 months is possible.

d. Suspension of your membership for any other reason is not possible.

 

ARTICLE 11: TERMINATION OF MEMBERSHIP

a. If you have entered into an agreement for a period of one year, you can terminate it no later than 30 days before the end of the term. If you do not do so, the agreement will be renewed (monthly) for an indefinite period and can then be terminated at any time with due observance of a notice period of one calendar month. The subscription will always be terminated on the 1st of the month.

b. You can only terminate your agreement in writing by email (info@gorilla-gym.nl) or by sending your termination by post to Gorilla gym, Paul Krugerstraat 251, 4382MH Vlissingen. Termination by word of mouth or in any other way is not possible.

c. A cancellation is only final once written confirmation/an email confirming the cancellation has been provided by Gorilla Gym staff.

d. At Gorilla Gym, we strive to create an environment in which everyone respects each other and the rules are followed. If you do not comply with the terms of the agreement, or if you do not comply with the house rules or exhibit unacceptable behavior, Gorilla Gym may deny you access to Gorilla Gym and terminate the agreement (with immediate effect). The assessment of the situation is reserved exclusively for Gorilla Gym.

e. Exercising together is encouraged at Gorilla Gym. However, coaching other athletes at Gorilla Gym is exclusively reserved for the personal trainers with whom we work. If you do offer personal training services, this may be a reason for us to terminate your agreement.

f. If you grant another person, member or non-member, illegal access in any way, for example by letting them walk through the entrance gate or by giving your personal pass to someone else to come and exercise, Gorilla Gym may charge you a fine equal to the value of a day pass and block your access to Gorilla Gym until this fine has been paid. In the event of multiple violations, Gorilla Gym may terminate the agreement.

 

ARTICLE 12: RISK AND LIABILITY

a. Practicing sports can involve risks. If you use our facilities, you must assess your own capabilities. We offer a maximum of 3 personal training sessions for new members of Gorilla Gym. You remain responsible for the way you exercise and the choices you make. Use of the facilities is at your own risk. If you have any doubts about your physical condition, we recommend that you seek expert advice from a doctor or specialist to determine the right and feasible way for you to exercise.

b. Gorilla Gym accepts no liability for damage to and/or loss of property belonging to the athlete or visitor, nor for any form of physical injury that may occur before, in, and around the gym, during or after classes, training sessions, and the use of the fitness facilities. 

c. The athlete participates in classes and training sessions at their own risk.

d. We advise you not to bring any valuables to Gorilla Gym. Gorilla Gym provides lockers, but their use is at your own risk. Experience has shown that no locker is safe from experienced thieves. Gorilla Gym accepts no liability whatsoever for damage, loss, or theft of your property. The lockers are emptied daily after closing time. Any clothing or other property left behind will be kept for a maximum of one week.

e. Lockers can be used with your own padlock. It is prohibited to leave items in the lockers overnight.

f. In the event of an emergency, the instructions of the Gorilla Gym staff and emergency response team must be followed. Ensure your own safety at all times and, if possible, the safety of others.

ARTICLE 13: CONFIDENTIAL MATTERS

2.1 Sexual abuse, discrimination, threats, harassment, and physical and mental abuse are unacceptable at Gorilla Gym. Confidential advisors have been appointed to help members who are affected by such issues. Khalid Zarin is the confidential advisor at Gorilla Gym.

2.2 The confidential advisor is there to listen, show understanding, and offer appropriate comfort if necessary. In addition, the person reporting the incident must be able to tell their story as clearly as possible. The confidential advisor can then find out what happened and assess the best next steps. Reports of sexually transgressive behavior are always treated confidentially. Confidentiality is not the same as secrecy. Confidentiality means that a confidential advisor may never share a report of inappropriate behavior with anyone without good reason. Specific reports of serious sexual misconduct, such as sexual harassment or assault, must be reported. To this end, the confidential advisor will contact the Center for Safe Sport.

2.3 The Martial Arts Authority has also written a Handbook on dealing with inappropriate behavior. Athletes, parents, trainers, gym owners, officials, and others can find information here about preventing and dealing with unacceptable behavior.

ARTICLE 14: COMPLAINTS

a. We do our utmost to serve everyone and want Gorilla Gym to give as many people as possible access to sports facilities. If you have any complaints, we regret that, but we would of course like to hear about them. You can, of course, first contact the host/hostess at Gorilla Gym and, secondly, send an email to Gorilla Gym (info@gorilla-gym.nl).

ARTICLE 15: PERSONAL DATA

a. In order to execute your agreement, we have access to your personal data. Gorilla Gym processes your personal data in a proper and careful manner and within the framework of applicable laws and regulations, such as the General Data Protection Regulation (GDPR).

b. To protect the safety of people and property in and around Gorilla Gym, we use video and audio surveillance equipment to monitor Gorilla Gym 24 hours a day. Video and audio surveillance is limited to the gym and is not present in the toilet, shower, and changing rooms.

c. We regularly make videos and take photos of the group lessons and our gym and share these on social media/our website, etc. These also feature people who exercise at our gym. If you are a member of our gym, you agree that we may share images of you online on these types of channels. If you do not want to appear in our images online, please let us know so that we can take this into account where possible.

d. Filming and taking photos of yourself is permitted during exercise, but this should not disturb other people. Our visitors are prohibited from filming other people in our gym without permission.

ARTICLE 17: FINAL PROVISIONS

a. By entering Gorilla Gym, you agree to comply with our house rules. If you violate the rules, we may deny you access to our premises. If a criminal offense is committed, the police will be called at all times.

b. Gorilla Gym reserves the right to change these terms and conditions at any time. Errors in these terms and conditions are reserved.

c. These general terms and conditions and all agreements entered into by or with Gorilla Gym are governed exclusively by Dutch law.

d. All disputes arising from the agreement between the member and Gorilla Gym will be assessed by the competent court in the district where Gorilla Gym is located.
